The Ghanaian Lens: Nana Darkwa’s Speedy Bail

A highly respected legal luminary, Lawyer David Annan, has raised serious questions over the hasty manner in which an appeal was purportedly entered, on behalf of the remanded NPP activist, Nana Darkwa on Friday.

Speaking on Radio Gold on Saturday, Lawyer David Annan, raised questions about the correctitude of the procedures followed in entering the appeal before the High Court that granted the NPP activist bail.

He pointed out that court procedures demand that in cases such as an appeal before a higher court, the proceedings from the lower court that is being appealed against must be signed by the trial judge and made available to the higher court.

Lawyer David Annan opined that given the haste with which the processes were rushed to grant the NPP activist bail on Friday, he cannot see how it could be possible that the trial judge who remanded the NPP activist into custody would have been able to furnish the High Court with the properly signed documents on the proceedings at the Circuit Court.

Lawyer David Annan has therefore directed those questioning the supposed haste with which Nana Darkwa was arrested, charged, arraigned before court and remanded into custody to also question the haste with which his appeal process was conducted.

Meanwhile, a text message doing the rounds seeks to implicate the Attorney General, Betty Mould Iddrisu in the hasty processes that led to Nana Darkwa’s release.

The text message, purporting to have originated from one of Nana Darkwa’s legal counsel (name withheld), alleges that it was the Attorney General who directed Nana Darkwa’s lawyers on which court they should file their appeal. As at the time of going to press, all efforts to contact the Attorney-General for her reaction to this allegation proved futile.
