The Editor-in-Chief of the New Crusading Guide newspaper, Abdul Malik Kweku Baako has stated that the decision to free the eight members of the Delta Force who were standing trial for invading the KMA court in Kumasi is ‘politically unwise’.
The Attorney General (AG) dropped the case against the eight members of the vigilante group, Delta Force, who were said to have aided the escape of 13 of their members. The eight were accused of aiding the escape from lawful custody of some 13 Delta Force members who were standing trial at the Kumasi Metropolitan Assembly (KMA) Circuit Court.
When the case was called Wednesday morning, the prosecution told the court that the Attorney General has advised the police to drop the charges against the eight accused persons. This was because, the AG after examining the docket concluded that there was no evidence to prosecute the case.
The freeing of the eight have received mixed reactions from members of the public.
And Kweku Baako who claimed the Attorney General, Gloria Akufo and her two deputies did not advice the prosecutor in the Delta 8 trial to discontinue the case described the decision as ‘politically impudent.’
“The advice may be legally sustainable (based on the contents of the duplicate docket) but politically impudent! A case of this nature should been allowed to run its full course in court. That’s my lay man’s take. My instincts tell me something dramatic could be brewing in the pot!,” he said.
According to the veteran journalist, the advice for the Attorney General to discontinue the case was offered by the Senior State Attorney in the Ashanti Region, Marie Louise-Simmons after studying the duplicate docket offered by the Police.
“My preliminary checks show the AG and her two Deputies had no idea of what happened or went into the advice to discontinue the prosecution of the Delta 8! Apparently, the Attorney General’s Department (Kumasi) in a letter dated May 9, 2017 signed by the Senior State Attorney, Marie Louise-Simmons on behalf of Chief State Attorney, advised the Prosecution to discontinue prosecution for lack of evidence after studying the Police Duplicate Docket!,” he stated in a text message to Asempa FM’s Ekosii Sen Programme on Wednesday.

It is sad that I stood in scorching sun and voted for Nana addo, thinking that he was coming to do better than the incompetence displayed by John mahama, but they way he has started makes me feel that all politicians are phony. We all spoke against the freedom given to the Montie three by executive authority. In my opinion, what the AG has done smacks of cronyism and nepotism. You cannot ride on the incompetence of mahama to power and come and do worse. If in the near future, these hoodlums strike again, who had caused it. Now they have been given the licence to possibly rrape the new chief justice and go Scot free. Remember it was a woman judge who was intimidated in court. This is irresponsible.

The prosecution failed the nation. They arrested innocent people who had gathered after the incident had happened. They admitted being members of the Delta force but they were not near where the incident happened. It was for the prosecution to prove that they took part in the action. Failure to do that means they cannot be held liable for what happened. The AG must stop using the Police for prosecution and get trained lawyers.
