The Petitioners, Thursday evening, released the full list of the 11,138 polling stations which contain violations, omissions, malpractices and irregularities for which they are asking the Supreme Court to annul. The list which details the polling station name, polling station code, pink sheet serial number of polling station, votes secured by the various parties in those polling stations and the particular irregularities which affected voting and the outcome of elections in those polling stations, proves the Petitioners case that there is no double counting of polling stations in the analysis of the number of votes and polling stations which should be annulled from the declared result of the 2012 Elections. Counsel for John Mahama, Tony Lithur, during the 3rd day of hearing of the substantive case at the Supreme Court sought to claim that the petitioners had engaged in double counting in their analysis. The lawyer for the 1st Respondent while cross examining the Petitioners principal witness, Dr. Mahamudu Bawumia, spent over 5 hours pulling out just 38 duplicate sheets found in the exhibits served on John Mahama, ostensibly to show that the analysis of the petitioners was full of double counting which affects the numbers the petitioners are seeking to annul. However, Dr. Mahamudu Bawumia, the NPP Vice-Presidential candidate stood his ground and made it clear to the court that the analysis of the numbers of votes and polling stations includes no double counting and that the duplicate exhibits arose as a result of errors in packaging. The list released on Thursday evening shows that should the court uphold the claims of the petitioners, 2,910,103 votes secured by John Mahama from the 11,138 polling stations would have to be annulled from his votes while 1,388,239 votes would have to be deducted from the votes of Nana Akufo-Addo. As stated in court on Thursday, these annulments arising out of the six (6) irregularities would mean that John Mahama would have received 40.39% of the valid votes cast in the December Elections while Nana Akufo-Addo would have received 58.37% and thus has to be declared winner of the Presidential elections. The Petitioners are asking the court to annul all the votes from the listed polling stations as a result of various irregularities in various combinations which affected the conduct and outcome of the elections in these polling stations. The six broad categories of constitutional, statutory violations, irregularities and malpractices which were identified in the analysis of the Pink Sheets which are the primary records of the elections are over voting, voting without biometric verification, absence of signatures of Presiding officers or their deputies on the pink sheets, Duplicate serial numbers, the use of same polling station codes for different polling station results and the use of unknown polling stations during the December elections.
