Supreme Court To Rule On Tsatsu's 'Line Of Questioning'

The Supreme Court will this morning rule on an objection raised by lead counsel for the petitioners on the line of questions by lead counsel for the third respondent Tsatsu Tsikata. Mr. Tsikata is seeking to question Dr. Mahamadu Bawumia on some a document he has tendered in as evidence to buttress his argument that petitioners acted in bad faith in challenging the results of the 2012 elections. According to Lawyer Philip Addison the respondent is seeking to ask questions on evidence which are not part of those submitted to the court. Meanwhile, the petitioners are also opposing moves by the first and second respondents who have also filed a motion in court seeking to cross examine some of the petitioners� key witnesses who deposed to their affidavit. The Supreme Court on Tuesday set May 16 to hear the motion filed by Mr Tsatsu Tsikata, Counsel for the NDC to cross examine some witnesses of the petitioners whose testimonies have come by affidavits. Mr Tsikata had claimed in his motion that some witnesses of the petitioners� have alleged in their affidavits that the Electoral Commission (EC) annulled some of the polling stations� results in their constituencies where there were over-voting. The witnesses are Ms Freda Prempeh, Member of Parliament for Tano South, Mr Nuamah, Member of Parliament for Berekum East and the Presiding officer for Savlugu-Nanton. Counsel on all sides agreed to the adjournment by the Supreme Court. Mr Justice William Atuguba, the presiding judge, in giving reasons for the ruling, said the first and second respondents had also filed similar motions and so it will be convenient to hear all motions at the same time. He therefore set May 16 for the hearing of the motions. In a related development, accounting firm, KPMG has agreed with the parties in the case on the modalities for the auditing of pink sheets as ordered by the court. The firm yesterday met with the party on how best to fast track the process.
