Lawyers for Executive Director of Centre for Freedom and Accuracy, Mr. Andrew Awuni have filed an appeal seeking to overturn Wednesday�s ruling which dismissed their client's challenge to the sale of Merchant Bank to Fortiz,a Private Equity Firm. The commercial court division of an Accra High Court presided over by Her Ladyship Sophia R. Bernasko Essah upheld Lawyer for Fortiz, Tony Lithur�s application praying the court to dismiss Mr. Andrew Awuni�s lawsuit against the Merchant Bank transaction. In his affidavit in opposition to the plaintiff�s lawsuit, Mr. Lithur argued that Mr. Awuni had acted in bad faith. The court reasoned with Mr. Lithur but did not slap any cost for damages on the plaintiff. The Plaintiff�s lead Counsel, Lawyer Egbert Faibile Junior hinted his determination to file an appeal against the ruling. Checks at the High Court registry uncovered that the appeal was filed after the court proceedings at about 2; 35 pm (Wednesday). According to Lawyer Egbert his client was unfazed about the court ruling and will pursue the matter at the highest level.
