2020 Election Petition: It’s Not The Duty Of EC To Chase NDC With Form 13 - Nana B Jabs

One of the Spokespersons for the 2nd Respondent in the 2020 election petition, Henry Nana Boakye has backlashed the camp of the petitioner for citing in the Supreme Court that they don’t have a copy of the EC's “Form Thirteen”.

According to Henry Nana Boakye, every political party at the national collation centre at the Head office of the Electoral Commission (EC) is entitled to Form Thirteen as the law demands of the Commission.

He added that the law, however, does not compel the Electoral Commission (EC) to chase the agents of the opposition National Democratic Congress (NDC) with Form Thirteen in their homes.

Speaking on Okay FM’s 'Ade Akye Abia' Morning Show, Nana B as he is popularly called said that it is not the fault of Electoral Commission (EC) that the National Democratic Congress (NDC) does not have a copy of Form Thirteen as it was the agents of the NDC that chose to leave the strong room without the document.

“The Form Thirteen that the NDC is claiming not to have is not the fault of the EC because on the day of collation at the national level, the NDC agents in the strong room had left and it is not the duty of the EC to chase the NDC to give them the Form Thirteen,” he argued.

He, therefore, told the opposition NDC to go to the Headquarters of the Electoral Commission (EC) to pick the Form Thirteen; thus, the petitioner cannot ask the Court to compel the Electoral Commission to provide the Form Thirteen in court.

“The NDC can go to the Headquarters of the EC for their Form Thirteen; it is there for them to pick up . . . there is nowhere the EC officials have to chase the party agents with the Form Thirteen in their homes. If they had stayed at the strong room, they would have received the document,” he stated.
