A Circuit Court in Accra has thrown out a plea by the Police Criminal Investigation Department [CID] to investigate NDC’s Communication Officer, Sammy Gyamfi’s mobile phone and Facebook records.
The court described CID’s ex parte application as “frivolous”.
Mr Sammy Gyamfi had sued the Attorney General and Inspector-General of Police [IGP] and prayed the court for an interlocutory injunction to be placed on the enforcement of a court order secured by the Criminal Investigations Department of the Ghana Police Service, to have his mobile phone and Facebook account records searched in connection with an alleged cybercrime.
In his application, Mr Gyamfi said on Tuesday, 17 December 2019, “I received a phone call from an officer by name ACP Herbert Yankson, Head of Cyber Unit of the Criminal Investigation Department (CID) of the Ghana Police Service that he has been authorised by the 2nd Respondent (IGP) to invite me based on a complaint received from the Jubilee House without more”, adding: “The 2nd Respondent’s authorised officer did not state any named or identifiable complainant except to say Jubilee House”.
Also, he said: “My attention has been drawn to an ex parte application by the 2nd Respondent’s authorised officer to the District Court for the records of my phone without indicating what specifically the 2nd Respondent is looking for and without any evidence that I have in fact committed or about to commit the alleged crime of forgery and spreading of false information to cause fear and panic”.

HAHAHA. Interesting. Why is it that in Ghana people are always addressed by their qualifications or educational titles they have? Lets stop this culture, it is not interesting. Let our work show and stop thrusting qualifications into peoples eyes. Many of us studied and maybe worked in the Europes and Americas and they are not interested in your qualifications but what you can create and sustain. We see a collection of educational letters as the apex of achievements. It is a shame. Anytime i travel to Ghana for work, i call people in my professional arena by their first name and they look at me in aghast as if it is an abberation. Wow. Meanwhile these very people are using, indeed chasing material produced by someone who has an Mres after a first degree. My lead in Europe is Oxon, Cambridge PhD but never called "Dr". He is interested in what he can do not the educational "letters" he has acquired. His letterheads and email signature does not even have his qualifications. Let our innovations show our worth not our qualifications. Indeed when i attended an interview for this very position, i was never asked what qualifications i had. It was after the interview that i was asked to see the administrator to provide the necessary documents.
Lawyer Kwadwo Agyare, please Facebook is a public forum. Whatever you post is there for the public to see unless the person deletes the post. If really Sammy published false information, you do not need his facebook password to access this information, just take a screenshot as your evidence before the post is deleted, and based on this you send the person to court. The Judge is right. The suit by CID is frivolous
