The Supreme Court has overturned a High Court’s decision leading to the removal of Professor Mawutor Avoke as Vice Chancellor of the University of Education, Winneba.
According to the unanimous ruling, the High Court in Winneba failed to take evidence from the parties in the case before granting judgment in default of defense.
The court also stated that the High Court breached the rule of natural justice by failing to afford the defendants a hearing.
The justices of the apex court said the High Court’s actions amounted to an error of law patent on the record.
Following the High Court’s ruling, Prof Avoke, together with six other Principal Officers of the University, was removed by the school’ Governing Council.
This was described by some lecturers as politically motivated.

YOU GUYS MUST NOT BE DECEIVED. READ CAREFULLY, IT IS THE DECISION OF THE HIGH COURT THAT HAS BEEN QUASHED. WHAT IT MEANS IS THAT THE HIGH COURT WILL HAVE TO RESTART THE CASE ALL OVER AGAIN AND GIVE PROF AVOKE THE OPPORTUNITY TO BE HEARD IN THE SUBSTANTIVE CASE. WHETHER THE SUBSEQUENT JUDGEMENT WILL GO IN HIS FAVOUR OR NOT IS ANOTHER THING ALL TOGETHER. FOR LACK OF UNDERSTANDING MY PEOPLE ARE DRAWING THE WRONG CONCLUSIONS
Politics cannot invade in our tertiary institution. Shame to Afenyo Markin.
Let politicians learn to leave management of our educational institutions alone. Some of these less thought through decisions put the name of the government into disrepute. A case in point is the dissolution of the KNUST council saga and this time UEW. Change in government doesn't mean leadership of various institutions must be changed particularly our educational administrations. It’s such a shame indeed.
So is this president a lawyer? Politics is destroying Ghana.
