The Supreme Court is considering a suit demanding the re-arrest of three NDC supporters whose three months jail term for contempt, was cut short by a presidential pardon.
The suit is one of three legal attempts seeking to challenge the decision by former President John Dramani Mahama to grant the pardon.
Alistair Nelson, Godwin Ako Gunn and Salifu Masse who were part of a political talkshow on Accra-based Montie FM were jailed July 27 2016 following threats, made live on radio, to kill some judges whose judgements they disagreed with.
They also threatened to rape the Chief Justice Mrs Georgina Theodora Wood on the same show.
Despite a three-month jail sentence handed by the Supreme Court, the NDC supporters were set free by the President, in August 22nd 2016, after they served more than three weeks in jail.
One of the plaintiffs, Nana Asante Bediatuo, is convinced that the presidential pardon granted the three was unconsitutional.
He has said the president has the power to pardon people convicted for criminal offences but does not have same to pardon convicts for criminal contempt.
President John Mahama is no longer in office after his government lost the general elections last December. Nana Asante Bediatuo is now Executive Secretary to President Akufo-Addo.
The hearing of the case has began at the Supreme Court Thursday. The apex court has granted a request by the Attorney General's Department to be given 7 days to file a response to the three separate suits filed in September 2016.
After the Attorney-General files a response within seven days, the court registrar is expected to set a date for the hearing of the case.
Fosua Amagyei who is counsel for Nana Asante Bediatuo, told Joy News "if the courts find our case favourable, they should go back to prison and continue where they left off".

Nana Addo is a man of LAW and will make the LAWS of this country work Again. He will not tolerate indiscipline in any form and to all NPP sympathizers if the Laws of this country catch you do not think Nana Addo will come AND help you OUT. Those guys must go back to Prison and learn sense there. Am still waiting for the Special Prosecutor.
Please read the article again and take good notice, the suits were filed in September well before the elections. So this has got nothing to do with the current government. But it's my plea, lets move forward,we need not look back, there is more work to be done.Case die!
hurrayyyyyyyyyyyyyyyyyy
They need to continue from where they left off. This will let them know that Ghana is not for a group of people. How can you say such filty words about our judiciary-Chief Justice Mrs Georgina Theodora Wood, that u will rape her! They think they were on drugs when they made that comment. After that you(Salifu Masse) wanted to flee to UK, knowing well that u are an ex-convict,after being refused the visa too u started to attack the consular. They need to go back to jail so that they will learn to respect people in authority
If you are in power be mindfull of what you do or say because power always change hands. They should go back to prison ***barred word***
let sleeping dogs lie. I don't think this is necessary now.We should let their own conscience judge them. Ghana needs to move forward now.....
Hmmmmmm. It would have been better if the Atorney-General of the Mahama administration is the one to carry out this defense. Will the current Attorney-general put up a solid defense so well-meaning Ghanaians will trust in our Justice and rule of law? I pray the current Attorney-General to put up the best defense as possible, so Ghanaians will have no reservations or qualms about the outcome of this particular case. Mmre bɛ kyɛrɛ. God bless Our homeland Ghana
